No hay antejardines en la Ciudad Jardín

No nos extrañaría que después de este rayado de cancha de la incorruptible Contraloría, las influyentes asociaciones empresariales automotrices y de la construcción, inicien sus prácticas de lobby ante los parlamentarios de ambos bandos y ante el gobierno para que, mediante modificaciones, la Ley General de Urbanismo y Construcciones sea lo suficientemente laxa para que todo sea posible, ello en aras del venerable crecimiento económico.

Según la regulación nacional de Urbanismo y Construcciones los antejardines son los espacios privados de los terrenos que limitan entre las líneas oficiales y las líneas de edificación fijadas en los Planes Reguladores Comunales (PRC) y cuando existan construcciones deben estar materializados como efectivas áreas verdes, es decir, con césped, flores y todo tipo de especies arbóreas. Pero como en Chile las normas continuamente son vulneradas, muchos propietarios o arrendatarios de inmuebles que los explotan comercialmente, para obtener mejores rendimientos económicos en sus emprendimientos, tales antejardines los transforman en espacios duros para exponer a los consumidores sus preciadas mercaderías.

Hace unos meses, Carlos Valencia, miembro de la Fundación Defendamos la Ciudad en la V Región de Valparaíso, denunció en la Contraloría General de la República que en Viña del Mar, conocida antiguamente como una excelente Ciudad Jardín, hoy en día innumerables antejardines de inmuebles que operan como compraventas de automóviles son utilizados impunemente por sus dueños como espacios para estacionarlos con el propósito de exponerlos al público, en ocasiones también ocupando las veredas y por lo tanto perturbando los desplazamientos de los peatones.

La Contraloría ejerció sus atribuciones legales y constitucionales, informándole a la alcaldesa Virginia Reginato, vía dictamen Nº 50843 del 8 de julio pasado, que en el plazo de 15 días hábiles, sus funcionarios deben ejercer las inspecciones de rigor para terminar con la exhibición de automóviles en los antejardines sin importar que cuenten “autorizaciones” impartidas por el Director de Obras Municipales DOM). Excediéndose en sus limitadas facultades reglamentarias, el PRC de Viña del Mar dispone que dicho DOM puede otorgar permisos de estacionamientos en los antejardines de los edificios de viviendas, en cantidades mayores a los 2 descubiertos que ocupen el máximo de 5 metros del frente del edificio, asunto también amonestado por el ente fiscalizador.

Como observamos, se acabaron los salones de venta de vehículos en los antejardines de los locales acondicionados para tal actividad mercantil en Viña del Mar y como el aludido dictamen tiene fuerza obligatoria para todas las ciudades del país, esperamos que los alcaldes ejerzan sus roles, con lo cual se respetará la ley y más importante, las ciudades estarán más despejadas y con mayores espacios verdes, luego, en un tiempo más, serán ciudades a escala humana.

En Valparaíso, a pesar de ser una ciudad puerto que ostenta el título de Patrimonio de la Humanidad, también sucede el mismo abuso privado y en tal sentido esperamos que el alcalde Jorge Castro, sin que nadie se lo exija, cumpla a cabalidad el dictamen en comento y que, en paralelo, instruya a su DOM, Matías Valdés, para que se regularice, con la correspondiente recepción final, la edificación pinochetista y clandestina que acoge al Congreso Nacional, asunto tratado públicamente en septiembre de 2014.

Mal que mal, muchos de los diputados y senadores han ganado las elecciones gracias al dinero de sus mentores.

Recordemos que con motivo de una centena de edificaciones ya construidas y otras tantas en construcción en Viña del Mar, la Comisión de Vivienda y Desarrollo Urbano de la Cámara de Diputados se ha negado sistemáticamente a conocer los ardides utilizados por las inmobiliarias para edificar mayores volúmenes, práctica viciada tolerada por la municipalidad, con lo cual se han generado a los titulares de esos proyectos varios millones de dólares en ganancias mal habidas.

Ahora esperamos que los diputados expertos en la materia se allanen a escucharnos, independientemente de que el asunto será indispensable llevarlo al Ministerio Público para que el Fiscal Regional investigue la razón de tantos y consecutivos “errores” a favor de ciertos actores regalones del mercado.
