El día 17 de marzo del presente, la Corte de Apelaciones de Valparaíso decidió trasladar a la Corte Suprema la decisión final acerca de las ilegalidades del mega proyecto comercial Mall Puerto Barón, debido a que los vecinos decidieron enderezar ante el máximo tribunal la sentencia que validó dicho proyecto que se pretender emplazar en el Sector Barón de la ciudad de Valparaíso, en una zona de peligro de tsunami, entre la línea férrea y el mar, y sin enfrentar una vía troncal y expresa exigida por la normativa urbanística.
Efectivamente, el recurso por el cual se ataca la sentencia de la Corte porteña que rechaza el reclamo de ilegalidad de los vecinos acusa aspectos formales y de fondo que los jueces locales no advirtieron en su fallo y que de haberlo hecho habrían arribado a la conclusión que el permiso de edificación que ampara ese mega proyecto es ilegal y debe ser anulado, acogiéndose en definitiva el reclamo interpuesto.
Los vecinos instarán a que el Máximo Tribunal enmiende el proceder de la Corte local y en definitiva anule el permiso de edificación otorgado por la administración del Ex- Alcalde Jorge Castro y si se quiere insistir con dicho proyecto, se tramite un nuevo permiso de de edificación que resguarde aspectos de seguridad por riesgo de tsunami para los visitantes y se ajuste el tamaño del proyecto a una escala adecuada a la vialidad del sector, la que no puede superar la vía férrea existente.
Al margen de este reclamo de ilegalidad, otro dolor de cabezas que debe superar la estatal Empresa Portuaria Valparaíso dice relación si el paso bajo nivel existente en el sector de Barón que está destinado para el centro comercial, a cargo de la transnacional de retail Falabella, o será entregado a la española OHL para el tránsito de camiones del denominado Terminal 2, luego del categórico fallo de la Corte Suprema que ratificó la preferencia que tiene TPS sobre el denominado Acceso Sur, contingencia que se encuentra en pleno desarrollo.
