Conservador de Valparaíso: 40 mil títulos de dominio sólo en Laguna Verde peligran por negativa de inscripción

El Conservador de Bienes Raíces de Valparaíso, suspendió la inscripción de las ventas de cesiones de derecho en la zona, para ello argumenta la Ley General de Vivienda y Urbanismo, en especial el articulo 136 de ésta, que dice que no será lícito realizar ventas “Mientras en una población, apertura de calles, formación de un nuevo barrio, loteo o subdivisión de un predio no se hubieren ejecutado todos los trabajos de urbanización”.

Por otro lado esta misma ley indica que los Conservadores no podrán inscribir, ni los Notarios realizar escrituras.

Esta Ley rige desde 1975 en los mismos términos que hoy, sin embargo el Conservador de Bienes Raíces inscribió las cesiones de derecho por 42 años, sin considerar esta norma. Nos referimos específicamente al articulo 137 que dice claramente que los Notarios no autorizaran escrituras, ni los Conservadores inscribirán escrituras si no se cumple con lo anterior.

Según el Conservador esto se producía hasta el año 2017 por razones de orden jurisprudencial, ya que, ante la negativa de inscripción el solicitante recurría a los tribunales competentes y como estos ordenaban las inscripciones decidieron hacerlas igual sin rechazarlas, olvidándose completamente de la Ley y sus responsabilidades.

Esa es la explicación entregada por el auxiliar de justicia que ejerce bajo el nombre de Conservador de Bienes Raíces y que además debe tener el titulo de abogado.

En el fondo habrían infringido la Ley porque los tribunales le obligaron a aquello por unos fallos en el sentido que procedía la inscripción de estos derechos, que ellos rechazaban.

No hay constancia de estos fallos y tampoco si el Conservador apelo a ellos o sólo se quedo con el fallo de primera instancia.

En esta materia el Conservador, suponemos, debería haber ejercido todos los recursos necesarios antes de empezar a infringir la ley en comento por 42 años.

Esta situación, la inscripción de derechos, realizada por el Conservador, según este funcionario inicialmente por instrucciones de los tribunales y posteriormente por motus proprio dio origen a nuevos títulos de dominio con fojas, número y año en similares condiciones a la inscripción de una compraventa, lo increíble es el número de títulos que son miles, solo acá en la región.

En la actualidad y desde hace poco más de un año no inscribe la venta de esos derechos que inscribió argumentando el mismo articulo 136.

Lo absurdo de esto es que cuando se vende el 100% de ese titulo, no existiendo posibilidad alguna de hacer una población y por lo tanto no se reúne ninguna condición de las estipuladas en ese articulo para rechazar la inscripción de estos derechos.

VÁLIDOS Y TRANSABLES

Mientras estos u otros títulos no estén anulados por un tribunal de la República siguen siendo validos y transables, pero eso no ocurre en la práctica, ya que el Conservador simplemente no inscribe y los tribunales no diferencian entre una venta de derechos inscritos y una situación que podría derivar en la creación de una población y el Conservador hace poco por aclararlo, ya que, carece de lógica que no inscriban los derechos que ellos inscribieron en su oportunidad y prefieren enredar la situación sin ir al fondo del asunto, que no es otro que cuando se vende el 100% de derechos no se puede formar una población con el saldo porque simplemente no hay saldo, ya que el 100% es el todo de algo.

Esto ocurre hoy día con todos los títulos de cesión de derechos en Valparaíso, solo la zona de Laguna Verde tiene mas de 40.000 títulos inscritos que ya no están en el comercio humano y que corresponden a la expropiación más grande en la historia del país en cuanto al número de afectados, pero esto es válido en todo Chile.

Esta expropiación no se produce por parte del Estado, sino que de un grupo de auxiliares de justicia que actuando discrecionalmente decidieron de motus propio cambiar el “criterio” de inscripción de derechos.

En la medida que los afectados tomen conciencia de este problema se convertirá en el mayor movimiento social de los últimos tiempos.

La inactividad en resolver este problema quizás sea solamente porque los afectados sean los más pobres del país y requieren más tiempo para llegar a darse cuenta de esta infracción a sus derechos a la propiedad consagrada en la Constitución.

Todos estos títulos de cesión de derechos a que nos referimos fueron realizados en Notaria e inscritos en el Conservador de Bienes Raíces, tal cual cualquier título de dominio.

  2. Esta perfectamente explicado y aclarado el tema de los sitios ya inscritos «Son títulos de dominio» por ende la gente debería tener toda la libertad de vender y se inscriba dicha venta , como lo hizo al comprar .
    No existe posibilidad alguna que se forme una población en un pequeño porcentaje .
    Ese criterio por el que se excusan para no inscribir es ridículo del ángulo que lo miren , y comparto también que la mayoría de las personas que adquirieron estos derechos no logran dimencionar bien claro que se los esta EXPROPIANDO literalmente .
    No pueden vender SUS PROPIOS DERECHOS , los cuales YA SE ENCUENTRAN INSCRITOS EN EL CBR .

  3. Debemos considerar que el conservador cayó en una falta muy grave, onactibiendo en forma ilegal y ahora que está todo inscrito, nosotros no podemos hacer gestiones con nuestras propiedades. Compramos legal, pagamos el valor que correspondía, escribimos en el conservador, o sea todo transparente y nos vemos involucrados en esta situación. Que injusto, hay personas que se toman terrenos, no pagan nada, nada, y luego se in tiempo les urbanizar, les dan un título de dominio, inscriben y ya… o sea que hay que actuar fuera de la ley para conseguir las cosas legales? A qué estamos jugando. Por ser honrados y honestos la ley nos castiga. Vivimos en el país del al revés?

Lamentable la situación que estamos viviendo, muchos compramos pensando que estaba todo dentro de lo legal, y me siento estafado por parte del conservador ya que ellos teniendo el conocimiento de igual manera inscribian, y mas encima ahora nos prohiben vender algo que nosotros legalmente pagamos e inscribimos en el conservador, como dice el articulo esto es una bulgar expropiación, que no respeta nuestros derechos como dueños de un porcentaje de una parcela. Necesitamos soluciones ya que muchos como en mi caso necesito vender urgente.

    Ósea aquí se aplica. el dicho de la ley del embudo. .
    Ojalá esto se solucione alguna vez..

    No es posoble que regularicen la tomas ilegales de la mayoria de los cerros de Valpo. y a nosotros que compramos nos limiten con nuestros proyectos y sueños de vida

Es como mucho que los que actuamos dentro de la ley, nos castiguen de esa manera, se está demostrando que impera la corrupción. no olvidemos que también hay algunos parlamentarios que también tienen terrenos dentro de laguna verde y ellos son los principales opositores a que laguna verde crezca en beneficio de sus parcelas.

  9. Aquí hay pájaros que se hacen los tontos y son buitres de mucho cuidado. Es mejor no dejarse convencer por ningún disfrazado de buena gente que a veces resulta ser un lobo hambriento y acaparador come el tal Félix de Pino que no es más allá que un buitre sin igual. Cuidado con él que ese tiene dientes y mandíbula de animal aterrador, ese ha estafado más gente de lo que Uds., se imaginan y se te hace amigo luego”zas” en la cabeza cuando menos te lo esperas. Mucho cuidado con esta rata sucia de cloaca que me vendió un terreno que no era para nada lo prometido y me fue sacando de a poco el dinero de mis ahorros de años a la fin era una quebrada asquerosa a la cual el solo tuvo que mover las estacas para engañarme en mi ignorancia al respecto del asunto, le creí porque me pareció buena gente a la fin resultó ser una bestia sedienta de dinero lleno de engaños y miserables embustes amistosos. ¡¡¡ Basura que eres una basura y las vas de buena gente pero quien te conoce sabe que eres un palo blanco del infierno nada más y que has venido aquí solo para hacer daño y enriquecerte a costas de las buenas gente, parasita de los terrenos no eres otra cosa que un parasita !!!

      Felix del pino es un todo personaje ha estado preso en concepcion por giro doloso de cheques y reiteradas estafas y esta prontuariado. PO eso no tiene moral ni etica, la perdio en la carcel de concepcion.

  10. Diario el faro; menudo diario si está en manos de este filibustero Félix Del Pino… seguramente la manada de ignorantes le rinde tributo a esta basura. Yo no le creo ni lo que reza a este elemento que no hace más que esconderse detrás de un innumerable tipo de artimañas para engañar a las gentes trabajadoras. La ignorancia durante milenios a dado de comer a prelados y estafadores con y sin sotanas y este es uno de ellos de traje y corbata con cara de buena gente siendo a la vez un buitre que se mueve sibilinamente por entre las gentes sediento de dinero sin mirar a quien para hacerse de este sea de la manera que caiga sin importar el daño ajeno.
