Certificados de Informaciones Previas (CIP) y Anteproyectos no generan derechos adquiridos, según la Contraloría y la Corte Suprema

1.- RESPECTO DE CIP: DICTAMEN n° 30891/12 de la CONTRALORIA :

«Acorde con lo expuesto, el CIP constituye un documento a través del cual la Dirección de Obras Municipales da cuenta de las normas urbanísticas del instrumento de planificación territorial aplicables a un predio según la zona o subzona en que se encuentre ubicado, así como de otros antecedentes relevantes derivados de tal circunstancia. En ese contexto, y a diferencia de lo manifestado por la Subsecretaría de Vivienda y Urbanismo en su informe, cabe precisar que dichos certificados no fijan las condiciones jurídicas aplicables al predio, las que, conforme a lo señalado, son establecidas por el respectivo plan regulador, ni otorgan derechos adquiridos a sus propietarios».

2.- RESPECTO ANTEPROYECTO: SENTENCIA CORTE SUPREMA (considerando 8°), ROL 1555-2015.

Octavo: Que sin perjuicio de lo anterior, la parte recurrida incorporó la Resolución 47 de 28 de noviembre de 2013 de la dirección de Obras Municipales de Valparaíso, que aprueba a la recurrente un ante proyecto de edificación en altura, que eventualmente podría ser afectado por el acto materia del reproche. Sin embargo, dicha aprobación constituye una mera expectativa y no un derecho indubitado, por lo que se encuentra fuera del ámbito de protección de la presente acción constitucional.
