Apuntan el fin del proyecto Hotel Decameron de Quintero al cumplir 3 años sin iniciar obras

Organización Dunas de Ritoque dio a conocer que este 9 de febrero, de acuerdo a las Ordenanza General de Urbanismo y Construcción, el permiso de obras otorgado por la Municipalidad de Quintero caducó automáticamente.

La Ordenanza General de Urbanismo y Construcción (OGUC) establece la pérdida de vigencia de un permiso a través de la caducidad señalada en su artículo 1.4.17., el cual dispone, en su inciso primero que: «El permiso caducará automáticamente a los tres años de concedido sí no se hubieren iniciado las obras correspondientes o si éstas hubieren permanecido paralizadas durante el mismo lapso”.

Este es el caso del proyecto Hotel Decameron que buscaba su emplazamiento en el sector de la Dunas de Ritoque en Quintero, y que de acuerdo a la citada norma, desde este viernes no contaría con autorización de edificación, al haber caducado el permiso otorgado por la Dirección de Obras de la Municipalidad de Quintero el 9 de febrero de 2015.

Andrés León de la Organización Dunas de Ritoque indicó que estos permisos caducan debido a la imposibilidad del titular de iniciar obras, “su evaluación ambiental aún no ha salido y ha tenido muchas demoras por problemas en el proyecto, sin la evaluación ambiental el proyecto no puede iniciarse y al pasar el tiempo correspondiente el proyecto muere”.

Agregó que a partir de las irregularidades en la tramitación del proyecto hotelero, es que se encuentra suspendido el director de Obras de Quintero, Luis Bernal Fermandois. “Las ilegalidades cometidas y el no cumplimiento de la normativa urbanística provocó que Contraloría lo retirará del puesto para sancionar a todos los culpables”, apuntó León.

El Vocero ambientalista explicó que los permisos fueron otorgados por el suspendido DOM pero en base a un plan regulador antiguo, lo que es irregular.

ÁREAS VERDES

Los titulares del proyecto si desean perseverar en su emprendimiento hotelero, deberán solicitar un nuevo permiso en base al Plan Regulador vigente que señala que los terrenos donde se pretende construir esta grabado como áreas verdes, zonas donde no se pueden entregar permisos de edificación para hoteles.

Ahora al haber caducado el permiso fechado el 9 de febrero de 2015,los titulares del proyecto si desean perseverar en su emprendimiento hotelero, deberán solicitar un nuevo permiso en base al Plan Regulador vigente que señala que los terrenos donde se pretende construir esta grabado como áreas verdes, zonas donde no se pueden entregar permisos de edificación para hoteles.

“El impacto de grandes construcciones en Dunas de Ritoque, una zona protegida y frágil no es sustentable, no se puede compensar o mitigar. Entre otros los recursos de agua en la zona son cada día más escasos y deben ser cuidados para no dejar a la población sin ese vital elemento, este Hotel iba a extraer entre 25 y 46 millones de metros cúbicos de agua al mes, por lo su impacto era altísimo en el medio ambiente”, explicó León.

“Esperamos que Contraloría pueda determinar todos los culpables de las irregularidades y que se adopten sanciones ejemplares para que esto no se vuelva a repetir”, recalcó.
